Terms of Service
Article 1 (Purpose) The purpose of these terms is to regulate the basic matters and other necessary matters with regard to the conditions and procedures for using the services provided by the 2023 OKFriends Homecoming Youth Camp (Online) (hereinafter referred to as "Online Training"). Article 2 (Definitions) (1) The terms used in this Terms of Service are defined as follows: 1. Service means the relevant services provided by the Online Training, which are available for members to use regardless of the types of device (including various wired and wireless devices such as PCs, TVs, and mobile devices). 2. Member means a customer who accesses the services of the Online Training, makes a service contract with the Online Training under this Terms of Service, and uses the services provided by the Online Training. 3. Identification (ID) means a combination of letters and numbers created by a member and approved by the Online Training for identification and use of the services. 4. Password means a combination of letters or numbers created by a member to verify their identity linked to the ID provided and for security purposes. 5. Content means online courses and other related information provided on the website of the Online Training. 6. Administrator means the person chosen by the Online Training for overall administration and smooth operation of the service. 7. Termination means the expression of will by the Online Training or a member to terminate the service contract after opening the service. (2) The definitions of terms other than terms related thereto referred to in paragraph 1 shall be prescribed by business practices and relevant Act and subordinate statutes. Article 3 (Publication and Amendment of Terms of Service) (1) The Online Training shall post the contents of this Terms of Service on the first page of the service so that members can easily recognize them. (2) The Online Training may amend this Terms of Service within the scope which is not violating relevant laws such as the "Act on the Regulation of Terms and Conditions" and the "Act on Promotion of Information and Communications Network Utilization and Information Protection, etc." (hereinafter referred to as the "Information and Communications Network Act"). (3) When the Online Training amends this Terms of Service, it shall notify members of the amended Terms of Service along with the current Terms of Service 30 days before the amended Terms of Service goes into effect in accordance with the method of paragraph 1, stipulating the effective date and reason for the amendment. However, if the amendment does not significantly affect the rights and obligations of members, notice shall be given at least 7 days before the effective date. (4) If a member uses the service after the effective date in accordance with paragraph 3, it shall be deemed that the member has agreed to the amended Terms of Service. If a member does not agree to the amended Terms of Service, the member may terminate the service contract. (5) If a fee-based customer terminates their service contract due to disagreement with any amendments to this Terms of Service, the refund policy that applies shall be in accordance with the terms of the Paid Service Agreement. Article 4 (Agreement to Use Service) (1) The agreement to use the service is concluded when the person who wishes to become a member (hereinafter referred to as the "applicant") agrees to the contents of this Terms of Service, applies for membership, and the Online Training approves such application. (2) In principle, the Online Training approves service use for applicants' application. However, the Online Training may refuse to approve applications or terminate the service contract later if any of the following categories apply: 1.Applicants who have lost their membership status previously under this Terms of Service. However, an exception shall be made for those who have passed one year after losing their membership status and have obtained the Online Training's approval for rejoining as a member; 2. Those who have used a name that is not their legal name or the name of others; 3. Those who have provided false information or failed to provide the information requested by the Online Training; 4. Those who apply in violation of other prescribed matters or whose approval is not possible due to their own fault. (3) In the case of an application in accordance with Paragraph 1, the Online Training may request real name verification and self-authentication through a specialized agency, depending on the type of member. (4) The Online Training may withhold approval if there is a lack of service-related equipment or if there are technical or business problems. (5) If the membership application in accordance with Paragraph 2 is not approved or is withheld, the Online Training shall, in principle, inform the applicant of the situation. (6) The time of the service contract conclusion shall be the point at which the Online Training completes the application process. (7) The Online Training may differentiate services, such as usage time, frequency, and service menus and others based on the policy for each membership class. Article 5 (Change of Member Information) (1) Members may view and modify their personal information at any time through the personal information management section. However, real name, ID, and country, which are necessary for service management, shall not be modified. (2) If there are any changes in the information provided during the previous registration application, members shall inform the Online Training of such changes by modifying them online or by using other methods such as email. (3) The Online Training shall not be responsible for any disadvantages caused by failure to notify the Online Training of any changes as stated in Paragraph 2. Article 6 (Obligation to Protect Personal Information) The Online Training shall make efforts to protect the personal information of members in accordance with trelevant Act and subordinate statutes, such as the Information and Communications Network Act. The protection and use of personal information shall be subject to the relevant laws and the Online Training's Personal Information Policy. However, the Personal Information Policy of the Online Training shall not apply to sites outside of the Online Training's official website. Article 7 (Obligation to Manage "Member's" "ID" and "Password") (1) Members are responsible for managing their own IDs and passwords, and must not allow third parties to use them. (2) The Online Training may restrict the use of a certain ID if the ID poses a risk of personal information leakage, goes against social norms and public morals, or may be mistaken for the Online Training or its administrator. (3) In case that a member becomes aware that their ID or password has been stolen or is being used by a third party, they must immediately notify the Online Training and follow its instructions. (4) If a member fails to notify the Online Training of the situation described in Paragraph 3, or fails to follow the Online Training's instructions even after notifying, the Online Training shall not be held responsible for any disadvantages caused by such failure. Article 8 (Notification to "Members") (1) Unless otherwise specified in this Terms of Service, the Online Training may notify the member via the e-mail address designated by the member or through an electronic memo within the service. (2) In the case of notification to all members, the Online Training may substitute individual notification stipulated in Paragraph 1 by posting the notice on the bulletin board of the Online Training for at least seven days. Article 9 (the Online Training's Obligations) (1) The Online Training shall not engage in any acts prohibited by relevant laws and this Terms of Service, or acts contrary to public morals, and shall make every effort to provide services in a continuous and stable manner. (2) The Online Training must establish a security system to protect members' personal information (including credit information) to ensure safe use of the service safely, and must disclose and comply with its Personal Information Policy. (3) The Online Training shall not disclose or distribute a member's personal information to a third party without the member's consent. However, exceptions are made in the following cases: 1. When required by a government agency under the provisions of laws, such as the Information and Communication Network Act; 2. When there is a request for investigation purposes related to crimes or a request from the Korea Internet Safety Commission; 3. When there is a request in accordance with procedures prescribed by relevant Act and subordinate statutes. (4) If a member's opinion or complaint regarding the use of the service is deemed legitimate, the Online Training shall address it and communicate the progress and outcome of the matter to the member through the bulletin board or email. Article 10 (Obligations of "Member") (1) Members shall not engage in the following activities when using the service: 1. Registering false information when applying or modifying; 2. Stealing others' information; 3. Modifying information posted by the Online Training; 4. Infringing on the copyright or other intellectual property rights of the Online Training and other third parties; 5. Damaging the reputation of the Online Training or other third parties, or interfering with their businesses; 6. Publishing or posting obscene or violent messages, videos, sounds, or other information that violates public order and good morals on the service; 7. Using the service for profit without the consent of the Online Training; 8. Transferring or donating the right to use the service, other status or rights to others under the service contract; 9. Collecting, storing, or disclosing the personal information of other members; 10. Transmitting or posting information (including computer programs) that is prohibited from transmission or posting by related laws; 11. Impersonating employees or administrators of the Online Training, or posting messages or sending emails using other member's name; 12. Posting or transmitting materials containing software viruses and other computer codes, files, or programs designed to destroy or disrupt the normal operation of computer software, hardware, or telecommunication equipment; 13. Engaging in other illegal or unfair activities. (2) Members must comply with all relevant laws, regulations, and provisions stated in this Terms of Service, as well as any precautions or notices provided by the Online Training. They must not engage in any activities that may disrupt the operations of the Online Training. Article 11 (Provision of "Service") (1) The Online Training provides the following services to its members: 1. Online education content; 2. All other services provided by the Online Training to its members through further development. (2) The Online Training may divide its services into specific scopes and designate separate times available for each scope. In such cases, the Online Training shall provide detailed information in advance. (3) The Online Training provides its services 24 hours a day, year-round. (4) The Online Training may temporarily suspend the provision of the service due to reasons such as maintenance, replacement or malfunction of computer and telecommunication equipment, communication interruption, or significant operational failures. In this case, the Online Training will notify members in the manner specified in Article 8 (Notification to Members). However, if there are unavoidable reasons that prevent the Online Training from notifying members in advance, it may provide notice afterwards. (5) The Online Training may conduct regular inspections if necessary to provide the service, and the time for such inspections shall be notified on the service screen. Article 12 (Modification of "Service") (1) The Online Training may modify all or part of the service, as necessary for operation or technology. (2) In the event of any modifications to the content, usage method, or usage time of the service, the reason for the modification, the details of the modified service, and the date of provision shall be posted on the initial service screen at least 7 days prior to the modification. (3) The Online Training may modify, suspend, or change all or part of the free services provided for the policy and operation needs of the "Overseas Korean Foundation" or "Busan YMCA." The Online Training shall not be obliged to compensate members unless otherwise specified by related laws. Article 13 (Provision of Information and Advertisement) (1) The Online Training may provide various information that is deemed necessary for members during the use of its services through notices or emails. However, members may refuse to receive emails at any time, except for responses to inquiries related to transactions or customer questions based on relevant laws. (2) If the Online Training intends to send the information stated in Paragraph 1 by phone or facsimile, it shall obtain the member's consent in advance. However, this does not apply to responses related to transaction information and customer inquiries. (3) The Online Training may post advertisements on the service screen, homepage, email, or other means related to the operation of the service. Members who receive emails containing advertisements may refuse to receive them from the Online Training. Article 14 (Copyright of Posts) (1) The copyright and intellectual property rights of the service shall belong to Online Training, except for member posts and works provided under an affiliate contract. (2) The copyright of member posts on the service shall belong to the respective author of the post. (3) Member posts on the service may be exposed in search results or service promotions, and may be partially modified or edited to the extent necessary for such exposure. In this case, members can take measures such as deletion, exclusion from search results, or making the post private through the customer center at any time (4) If the Online Training wishes to use member posts in a manner other than stated in Paragraph 3, it must obtain the member's consent in advance via methods such as phone, fax, or email. Article 15 (Management of Posts) (1) If a member's post contains content that violates relevant laws such as the Information and Communications Network Act and the Copyright Act, the copyright owner may request the Online Training to suspend or delete the post in accordance with the procedures prescribed by the relevant laws, and the Online Training must take necessary measures in accordance with the relevant laws. (2) Even if there is no request from the copyright owner under Paragraph 1, the Online Training may take temporary measures on the relevant post if the copyright is infringed or if the post violates the school policy or other relevant laws. (3) The Online Training may delete the content that a member has posted or registered without the member's consent if it is deemed to fall under any of the following items: 1. Defamation or slander of other members or third parties, tarnishing the reputation of others; 2. Violation of public order and morals; 3. Cases where it is deemed to be associated with criminal acts; 4. Infringement upon the rights of third parties, including the copyrights; 5. Violation of other related laws or the rules set by the Online Training. Article 16 (Termination of Contract) (1) A member may apply for termination of the service contract at any time through the customer center on the initial screen of the service or the "My Information" menu, and the Online Training must process it immediately in accordance with relevant laws and regulations. (2) If a member terminates the contract, all of the member's data shall be destroyed immediately, except for the minimum personal information (name, country, and others) that the Online Training needs to maintain in accordance with relevant laws and the privacy policy for the purpose of complying with the relevant laws and regulations or retaining education history as follows: 1. Record on the basis for evaluation: - Reason for retention: Confirmation of completion of online education - Retention period: 4 years 2. Record on the training: - Reason for retention: Article 7 of the Regulations on Office Management, Article 4 and 5 of the Rules on Classification and Retention of Official Documents - Retention period: Permanent 3. Record regarding complaints or dispute settlement from members: - Reason for retention: Act on the Consumer Protection in Electronic Commerce, etc. - Retention period: 3 years 4. Record regarding visits: - Reason for retention: Protection of Communications Secrets Act - Retention period: 3 months (3) If a member terminates the contract, all posts written by the member that are registered on their account, such as emails and blogs, shall be deleted. However, posts that have been saved or scraped by others, or posts that have been registered on public bulletin boards, shall not be deleted. Members must delete these posts in advance before withdrawing Article 17 (Restriction on Use) (1) In case a member violates their obligations under this Terms of Service or interferes with the normal operation of the service, the Online Training may restrict their use of the service gradually by issuing warnings, temporarily suspending their account, or permanently terminating their account. (2) Despite the preceding paragraph, the Online Training may permanently terminate a member's account immediately if they violate any relevant laws, such as the Resident Registration Act by stealing others' identity or payment information, providing illegal programs violating the Copyright Act and Computer Programs Protection Act, interfering with the operation, engaging in illegal communication or hacking violating the Information and Communication Network Act, distributing malicious programs, or surpassing access rights. In the case of permanent termination under this paragraph, all coupons and other rewards obtained through the service shall also be terminated, and Online Training shall not compensate for them separately. (3) If a member does not log in for six months or more, the Online Training may restrict their access to the service to protect member information and ensure efficient operation. (4) Online Training shall be subject to restrictions and restrictions within the scope of use restrictions in this section, as prescribed by the use restriction policy and operation policy for individual services. (5) In case of restricting access to the service or terminating the contract under this article, the Online Training shall notify the member in accordance with Article 8 (Notification to Members). (6) Members may file an objection regarding the restriction under this article, in accordance with the procedure set by the Online Training. If the objection is deemed legitimate by the Online Training, the service will be immediately resumed. Article 18 (Limitation of Responsibility) (1) In the event that the Online Training is unable to provide the service due to force majeure or an irresistible force beyond the control of a state, the Online Training shall be exempt from responsibility for the provision of the service. (2) The Online Training shall not be held responsible for any service disruptions caused by a Member's fault. (3) The Online Training shall not be held responsible for the reliability, accuracy, or any other aspect of the information, data, or facts posted by members in relation to the service. (4) The Online Training shall be exempt from responsibility for any transactions between members or between a member and a third party through the service. (5) The Online Training shall not be held responsible for any free services unless there are special provisions in relevant laws. Article 19 (Applicable Law and Jurisdiction) (1) Laws of the Republic of Korea shall govern any disputes between the Online Training and its members. (2) Disputes between the Online Training and its members shall be subject to the jurisdiction of the court under the Civil Procedure Act. Article 20 (Application of Regulations) Matters not stipulated in this Terms of Service shall be governed by relevant laws and regulations, such as the Act on Consumer Protection in Electronic Commerce, etc. Matters not stipulated in the law shall be governed by customary practices. Supplementary Provision (1) This Terms of Service is effective from May 12, 2022.
